S’whales uses cookies and other techniques such as web beacons and software development kits on its online store and related sites (hereinafter the “website”, “online store”, “online shop” or “service”) as well as in its email communications and push notifications (hereinafter “communications”). We use cookies to enhance the user-friendliness of your visit(s) to our online store. This cookie policy explains how we use cookies and how we share and protect your data on our website www.swhales.eu. In our commitment to ensuring your privacy, we provide you with as much information as possible below about the use of these techniques, including S’whales’ cookies.

We only use marketing cookies if you have given us your permission. If you do not grant permission, advertising will still be displayed, but it will consist of randomly selected ads.

Who is responsible for processing your data?

S’whales B.V. (hereinafter “S’whales”, “we”, “us” or “our”), a company registered in the Trade registry of the Chamber of Commerce and having its address at Zandheuvel, 52-B, 4901HW Oosterhout, The Netherlands, is responsible for processing your data, such as described in this cookies policy. This cookie policy applies to all areas linked to our website and its communications. We use cookies and collect your data in a manner that complies with the General Data Protection Regulation (“GDPR”), the Dutch telecommunication law, and all other relevant legislation currently in effect.

What are cookies?

Cookies are small text files which are saved on your computer, tablet or mobile phone when you use our website. There are also cookie-type techniques that achieve the same results. This also applies to our communications. Cookies are not capable of harming your computer, tablet or mobile phone. Cookies are needed to be able to provide you with a smooth functioning Service.

What are the other cookie-type techniques?

Web beacons, Local and Session Storage, and SDKs are standard internet techniques that, sometimes along with cookies, enable a system to collect and then send information. Cookies and other techniques are used in all existing online stores. By using cookies and other methods, we ensure, for example:

  • Browsing S’whales’ online store becomes more enjoyable and easier for you.
  • You don’t receive or have to repeatedly enter the same information during your visit to our online store.
  • We can offer you special features such as the wishlist or your shopping cart.
  • We can measure how our online store is used and identify areas for improvement.
  • We can assess how our communications are read and how we can enhance them.
  • We can show you advertisements and recommendations based on your interests.
  • We can recognize the device you use when you visit us.
  • We can (have) record the frequency at which an advertisement is displayed, allowing us to better tailor ads to your needs and interests, and to avoid consistently showing you the same advertisement.

Third-party cookies

Third-party cookies are also placed through our online shop. The use of cookies by other companies is subject to the privacy and cookie policy of the respective company.

Which cookies do we use?

We use three types of cookies, namely functional cookies, analytical cookies and marketing cookies. However, we will only activate and use the marketing cookies with your explicit consent. If you choose not to consent to the use of marketing cookies, the Service will work less smoothly than with marketing cookies enabled.

Functional cookies

Functional cookies are essential for the proper functioning of the Service. Without these cookies, the Service cannot operate effectively. This means that these cookies cannot be turned off. There is a distinction between session functional cookies and permanent functional cookies. Session cookies are deleted after you leave the Service, while permanent cookies are saved to prevent you from having to repeat the same actions. An example of the use of permanent cookies is storing purchases in your cart on a shopping website. We do not share the information obtained with these cookies with third parties. Here is a list of their uses:

  • Memorization and storage of items you add to your wishlist.
  • Communication in case of an unfinished order so that you don’t lose the items in your shopping cart.
  • Saving browser settings so you can view our online store optimally on your screen.
  • Memorization of items you’ve viewed so you can quickly return to a previously viewed item.
  • Ability to save your login details so you don’t have to enter them each time.
  • Ability to respond to messages in our online store.
  • Regular loading of the website to ensure easy accessibility and continued optimal functioning.
  • Detection of potential abuses or issues in our online store, for example, through consecutive failed login attempts. For this, we also use Google reCAPTCHA (see Google’s privacy policy and terms of use).

Analytical cookies

With the help of third parties, we use analytical cookies to study the use of the service. Among other things, these statistics give us an overview of the frequency of visits and the improvements we can make to our online store. This enables us to continually optimise the user experience of our website.

Below is a list non-exhaustive of their uses:

  • Keep track of the number of visitors to our online shop.
  • Measure the length of a visit.
  • Measure how long it takes before a page has been loaded.
  • Know which buttons are clicked by people visiting the online store.
  • Measure how many customers have consulted our communications.
  • Measure the success of an advertising campaign.
  • Determine the order in which a visitor visits the different pages of our online shop.
  • Determine which items and pages can be linked together.
  • Know what people search for on the website.

The following data are stored, among others:

  • The IP address, which is anonymised.
  • Technical characteristics, such as the browser you are using (such as Chrome, Safari or Firefox), the resolution of your computer screen, your language preference and the device you are using.
  • From which page or advertising campaign you arrived on the website.
  • When and for how long you visit or use the online store.
  • Whether you use the online shop’s functionalities. For example, creating a wishlist, placing an order or consulting previous purchases.
  • Whether our communications are read.
  • The pages you visit in our online shop.

The following third parties support us to study the use of the service:

  • Google Analytics: We use Google Analytics for our analytical services. Google Analytics places a permanent cookie to identify your browser. By doing this, your data are shared with Google. We only share data with Google that we are allowed to share with Google according to the GDPR. We use this information combined with other data from other users. Due to this, we are unable to identify you as an individual. We have not given Google permission to share your data with third parties. However, Google can be legally obliged to share your data with third parties. The information which is obtained by Google is anonymized as much as possible. For more details, please refer to Google’s privacy policy and terms of use.

Marketing cookies

In our online shop, you will see recommendations, promotions and advertisements from us and from third parties. You may also see our advertisements on third-party websites. To keep these recommendations, promotions and advertisements relevant, we use marketing cookies. These cookies allow us to :

  • Keep track of which advertisements you have already seen.
  • Know how many times you have already seen an advertisement.
  • Prevent you from seeing the same advertisement over and over again.
  • Remember whether you click on advertisements.
  • Remember whether you place orders after seeing or clicking on an advertisement.
  • Measure whether you read our communications and which links you click on, to make these communications as relevant as possible to you.
  • Combine your browsing, search and purchase behaviour online, regardless of the device you use, and build audience segments based on this (combined) data.
  • To use compound segments to assess your advertising interests and to tailor advertisements on our online shop and third-party websites accordingly.
  • To use these segments in campaigns run by third parties, both on S’whales’ websites and on other third-party websites.

Advertising networks and media agencies serve as intermediaries for online shops and advertisers. Marketing cookies from these third parties allow us to:

  • Show you advertisements from third parties.
  • Our advertising partners can associate your preferences on swhales.eu with the information they collect when you visit other websites.

To find out more about the cookies placed by these parties for marketing purposes, please refer to the statements made by these third parties on their websites. As these statements may be subject to change from time to time, we advise you to consult these privacy and cookies policies regularly. Below is a list of third parties who place cookies and/or other cookie-type techniques via our online shop:

Tracking cookies

Tracking cookies, also known as third-party cookies, are marketing cookies. These cookies enable the tracking of your online activities across various websites, allowing the creation of user-profiles and delivering targeted advertising. Thanks to tracking cookies, we can adapt the content you see to your interests and preferences. These cookies make sure that you will only see relevant advertisements.

Remarketing

S’whales uses remarketing services to display ads on third-party websites to users who have previously visited our Service. Remarketing cookies are a part of the tracking cookies that we use on the Service. We, and our third-party vendors, use cookies to inform, optimise and serve ads based on your past visits to our Service.

Social media cookies

Our pages contain buttons from social media, such as Facebook and Instagram. These buttons come with a code which has been made by these networks themselves. These codes, when interacted with, place cookies on the Service, and are implemented by the social networks themselves. We cannot influence this process. Please read the respective social network’s privacy policy to see how these companies treat your (personal) data and please beware that these policies are open to change. The information which is obtained by these social networks is anonymised as much as possible.

Unforeseen cookies

We are constantly trying to keep a good overview of the cookies on our website. However, third parties may place cookies on the Service. If that happens, you will not find these cookies in this overview. This mainly concerns embedded elements, for example, cookies from an embedded YouTube video. Do you find cookies on the Service that are not listed in this overview? Then please contact us by sending an email here.

Turning cookies on and off

We only place analytical marketing cookies with your explicit consent. If you have given your consent, you can always withdraw it by ensuring that your browser stops saving these cookies. If you do not want websites to be able to save cookies on your computer, you can adjust your browser settings. You will then receive a warning before cookies are placed.

You can also adjust your settings to have your browser refuse all cookies or only third-party cookies. You can also delete cookies that have already been placed. Please note that you must adjust the settings separately for each browser on each device you use. We would like to draw your attention to the fact that if you do not wish to use cookies, we, unfortunately, cannot guarantee the proper functioning of our online shop. Some functions of the online shop may be lost, or you may not be able to see certain pages at all. Additionally, rejecting cookies does not mean you will no longer see advertisements. However, the advertisements will no longer be tailored to your interests and may repeat more frequently. The way you can adjust your settings varies from one browser to another. Click on one of the links below to go directly to your browser’s user guide, or consult your browser’s help function if needed:
